During the entire trial Ashley was permitted to wear these elbow length gloves as a part of her theatrics. She claimed that they were to cover her scars from cutting herself that they made out to be my fault. At no point did anyone ask her to remove the gloves. Ashley had been in and out of mental institutions due to her behavior and self-mutilation.
What I find to be interesting is that all of that was blamed on me, and I had at trial, and still have, her school records that contain incident reports of her threatening other classmates and acting out before I even met the Lopez family. The prosecution was very crafty in how she manipulated the outcry witness statute; the court allowed two instead of the one that is allowed by the statute. Everyone that took the stand was repeating what they had been told by Ashley.
I found out after trial that with her being 18 years old that my attorney should have objected to the outcry witness giving their testimony.
If you take all of hearsay and hearsay upon hearsay testimony out of this case we are left with her word against mine. Which becomes real flimsy when you factor in her history of making false accusations and over all behavior her entire life.
Margaret Lopez, The loving grandmother who gave her testimony as one of the outcry witnesses. Margaret Lopez is the root of this entire fiasco, she claimed that Ashley told her in 2001 when she was 8 years old that Bobby touched her. This allegedly took place while her and Ashley were watching one of the Michael Myers Halloween movies. Who watches one of those movie's with an 8 year old ?
Margaret Lopez claimed that she questioned Ashley and asked her several times did he go all the way in which she replied no. Margaret Lopez goes on to claim that she allows Ashley to make the decision to NOT call the police and file a report. Margaret Lopez was an employee at Providence hospital at the time and an adult over the age of 18 years old, which sec.261.101 applies to her.
Why would a responsible adult and loving grandmother not call the police if her granddaughter told her someone had touched her inappropriately? Why would you let almost 9 years go by before a report is made? Ashley said at trial that her grandmother badgered her for years to file a report of rape when the claim was Bobby touched me. Margaret Lopez manipulated Ashley into placing blame on me for her son Bobby's actions and pushed the issue of something more happening to keep me far from my son's life forever.
Margaret Lopez broke the law by not calling the police and openly admitted to it in court.
Margaret Lopez goes on to claim that Dr.Madisetty had suggested a test to be done on Ashley to confirm sexual abuse Margaret Lopez claimed to had REFUSED the test to confirm sexual abuse. Why?
Sec.261.101 clearly states that if a professional SUSPECTS any kind of abuse he must report it within 48 hours. No report is on file with Waco police department or child protective services.
Margaret Lopez's actions speak far louder than words; these are not the actions of a loving and responsible grandparent.
I had at trial Ashley's school record from St.Albans that states Robert A.Lopez (Bobby) was not her father and not allowed to pick her up from school.
Why would Ashley's uncle Bobby not be allowed to pick her up from school when everyone else in the family is?
Remember, the initial claim was Bobby touched me and Ashley lived with grandma in a house that uncle Bobby owned, combined that with the fact that she greatly disapproved of me seeing her daughter and in 2001 Sonya Lopez would have just had my son.
I learned of Robert Anthony Lopez's arrest in 2013 after my conviction by sheer accident, I had an unfortunate event that landed me in what you may know as the hole, and removed me from my normal day to day routine of work, I sat back their for 99 days doing nothing but listening to the radio and reading transcripts when I heard on the radio of his arrest.
